Coaching Program Terms & Conditions

These Terms & Conditions apply to coaching programs and private coaching containers provided by Kathleen Davidson Global Limited (“we”, “us” or “Kathleen Davidson”).

They apply whether you choose to pay for your program in full or through an agreed payment plan.

The specific program, inclusions, total investment and, where applicable, payment schedule will be confirmed at the time of purchase.

1. Program Commitment

By purchasing a coaching program, you are enrolling in and committing to the full program.

Your purchase provides access to the coaching, courses, resources and other inclusions specified in the particular offer you have purchased.

Where you choose a payment plan, the payment plan is simply a method of paying the total program investment in instalments. It is not a monthly membership or subscription.

2. Coaching Container and Commencement Date

Unless otherwise specified in your individual offer, the active coaching container runs for three months from the date of your first coaching session (“Commencement Date”).

Where your program includes six private coaching sessions, these sessions are designed to be used during the three-month coaching container.

We understand that circumstances may occasionally require greater flexibility. For this reason, all included private coaching sessions may be used for up to six months from your Commencement Date.

Any sessions remaining unused after six months will expire unless an alternative arrangement has been agreed by Kathleen Davidson in writing.

Coaching sessions are personal to you and are non-transferable. They cannot be transferred, gifted, exchanged, sold or used by another person.

3. Program Inclusions

Your individual offer will specify what is included in your program.

Depending on the program, this may include:

  • Private coaching sessions;

  • Online courses;

  • Digital resources and educational materials;

  • Workbooks and recordings; and

  • Any additional resources or support specifically included within your offer.

Your individual program inclusions will be confirmed at the time of purchase.

4. Payment

Your total program investment will be confirmed at the time of purchase.

You may pay the full program investment upfront or, where offered and agreed, through a payment plan.

If you choose to pay in full, the full program price is payable at the time of purchase unless otherwise agreed.

If you choose a payment plan, you are committing to the full program investment. Your individual instalment amounts and payment dates will be confirmed at the time of purchase.

A payment plan is not a pay-as-you-go arrangement, monthly membership or subscription. Commencing the program represents a commitment to the full program fee, regardless of whether you subsequently choose to use all coaching sessions, courses or other program inclusions.

All instalments must be paid on or before their agreed due dates.

If a scheduled payment fails or becomes overdue, you are responsible for arranging payment promptly.

We reserve the right to pause future coaching sessions, support and/or access to program materials while payments remain overdue.

An overdue or failed payment does not cancel your obligation to pay the remaining balance.

If circumstances arise that may affect your ability to make a scheduled payment, please contact us as soon as possible. Any variation to an agreed payment schedule is at our discretion and must be confirmed in writing.

5. Cancellation Before Your First Coaching Session

If you decide to cancel your program before your first coaching session, you must notify us in writing.

A 10% cancellation and administration fee will be deducted from any amount being refunded. This covers transaction fees, banking and payment processing costs, and administrative costs incurred in processing your purchase and subsequent cancellation.

Any remaining refundable balance will then be returned to you.

6. Cancellation After Commencement and Refunds

Your coaching program is considered to have commenced once your first coaching session has taken place.

Once your program has commenced, payments already made are non-refundable for change of mind.

If you are paying through an agreed payment plan, all remaining instalments continue to be payable after commencement, even if you subsequently decide not to participate in or complete the program.

Choosing not to attend coaching sessions, complete included courses, access resources or otherwise participate in the program does not create an entitlement to a refund or cancel your remaining payment obligations.

Nothing in these Terms & Conditions limits any rights or remedies that cannot lawfully be excluded under applicable New Zealand law.

7. Coaching Session Cancellation and Rescheduling

A minimum of 24 hours’ notice is required if you need to cancel or reschedule a coaching session.

Where less than 24 hours’ notice is provided, or you do not attend a scheduled session, the session may be treated as used.

We recognise that genuine illness, emergencies and unforeseen circumstances occur. Exceptions may therefore be made at Kathleen Davidson’s discretion.

Where possible, please contact us as soon as you know you will be unable to attend your scheduled session.

Repeated cancellations or rescheduling do not automatically extend the six-month period available for completing your coaching sessions.

8. Ongoing Course Access

Where online courses are included within your coaching program, you will receive ongoing access to those courses.

Your courses do not need to be completed within the three-month coaching container or the six-month period available for completing your coaching sessions.

Course access is intended to remain available to you on an ongoing basis, subject to the relevant courses, content and hosting technology continuing to be available.

From time to time, course content may be updated, revised, replaced or moved to another platform. Kathleen Davidson Global Limited reserves the right to make reasonable changes to course content, structure, delivery method or hosting platform.

9. Intellectual Property

All courses, coaching materials, videos, recordings, teachings, methodologies, concepts, written materials, workbooks, exercises, resources, graphics and other original content provided through our programs remain the intellectual property of Kathleen Davidson Global Limited unless otherwise stated.

Your purchase provides you with a personal, non-exclusive and non-transferable right to access and use these materials for your own personal development.

You may not, without prior written permission:

  • Copy, reproduce or substantially replicate our course or coaching materials;

  • Share your course login or provide another person with access to your account;

  • Record or distribute private coaching sessions unless expressly permitted;

  • Share, publish, upload or distribute course videos, recordings, workbooks or resources;

  • Sell, licence or commercially distribute our program materials;

  • Reproduce our proprietary materials within your own course, coaching program, membership, workshop, training or other commercial offering; or

  • Present our original materials, teachings or content as your own.

You are free to apply the insights, knowledge and personal learning you gain through coaching and our courses to your own life and work.

These intellectual property provisions protect our original content and materials and do not claim ownership over your personal experiences, insights, ideas or development.

10. Confidentiality and Privacy

Private coaching sessions are confidential.

Information you share within your private coaching relationship will be treated respectfully and confidentially, except where disclosure is required by law or where there is a serious and immediate concern relating to safety.

You are also expected to respect the privacy and confidentiality of other individuals whose personal information you may encounter through any group component or shared program environment.

11. Personal Responsibility and Coaching Outcomes

Coaching is a collaborative process. Your experience and results depend on many factors, including your individual circumstances, participation, choices and implementation.

No particular personal, relationship, spiritual, financial, business or other outcome is promised or guaranteed through participation in coaching or completion of accompanying courses or materials.

You remain responsible for your own choices, decisions, actions and wellbeing throughout the coaching relationship.

Coaching and educational materials are not a substitute for medical, psychological, legal, financial or other appropriately qualified professional advice where such advice is required.

12. Relationship, Spiritual and Divine Union Coaching

Where a coaching program relates to relationships, spiritual development, sacred union, divine union, personal transformation or similar areas, participation does not guarantee any particular outcome involving another person.

This includes any guarantee of reconciliation, contact, a romantic relationship, physical union, commitment from another person or a particular timeframe in which an outcome may occur.

The coaching is designed to support your own personal development, understanding, embodiment and experience.

You remain responsible for interpreting your own experiences and making your own decisions regarding your relationships and personal life.

13. Individual Arrangements

From time to time, Kathleen Davidson may agree to an individual payment schedule, coaching schedule or other arrangement that differs from the standard offering.

Any individual arrangement must be confirmed in writing.

Unless specifically varied in writing, all other provisions of these Terms & Conditions continue to apply.

14. Acceptance of Terms

By purchasing or enrolling in a coaching program and making payment, whether in full or through an agreed payment plan, you confirm that you have read, understood and agreed to these Terms & Conditions.

These Terms & Conditions are governed by the laws of New Zealand.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available to you under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other applicable New Zealand law where those rights cannot lawfully be excluded.

This version means you can attach exactly the same policy whether someone pays NZ$1,800 upfront, pays three instalments, or you agree to a different payment schedule for an individual client. You only need to specify their particular price and payment schedule at checkout/in writing.

The NZ consumer-law carve-out at the end is worth retaining: services supplied to consumers carry statutory guarantees, including reasonable care and skill, irrespective of your own refund policy. (Consumer Protection)
